Welcome to Pointcoin! These Terms of Use ("Terms") govern your use of the Pointcoin mobile application and related services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Accounts

When you create an account with us, you must provide us with accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

2. User Conduct

You agree not to use the Service to:

• Violate any laws or regulations
• Infringe on the intellectual property rights of others
• Upload or transmit viruses or any other type of malicious code
• Collect or track the personal information of others
• Interfere with or disrupt the Service or servers connected to the Service
• Engage in any fraudulent or illegal activities
• Create multiple accounts or use automated tools, scripts, or bots
• Attempt to manipulate, exploit, or game the reward system

3. Fraudulent Activity and Prohibited Conduct

Pointcoin reserves the right to determine, in its sole and absolute discretion, what constitutes fraudulent activity. "Fraudulent Activity" includes, but is not limited to:

• Any violation of these Terms of Use or any other policies or guidelines
• Suspicious account behavior or patterns of use
• Attempts to manipulate, exploit, or game the reward system or any aspect of the Service
• Use of automated tools, scripts, bots, or any non-human interaction with the Service
• Creation or use of multiple accounts by the same individual or entity
• Sharing, selling, or transferring accounts or account credentials
• Any activity deemed abusive, deceptive, or conducted in bad faith
• Violations of applicable laws, regulations, or third-party rights
• Any attempt to circumvent security measures or access controls
• Providing false, misleading, or incomplete information
• Any other conduct that Pointcoin determines, in its sole discretion, to be harmful to the Service, other users, or Pointcoin's business interests

4. Company Rights and Remedial Actions

Pointcoin reserves the unilateral right, exercisable at any time and in its sole and absolute discretion, without prior notice or liability, to:

• Cancel, void, or refuse any reward redemption requests
• Remove, revoke, forfeit, or confiscate any earned rewards, points, or benefits
• Suspend, restrict, or permanently delete user accounts
• Block or restrict access to the Service from specific devices, IP addresses, or geographic locations
• Investigate suspected fraudulent activity and cooperate with law enforcement
• Modify, suspend, or discontinue any aspect of the Service or reward program
• Take any other remedial actions deemed necessary or appropriate to protect the integrity of the Service

These rights may be exercised for any reason, including but not limited to suspected fraudulent activity, violation of these Terms, or to protect the interests of Pointcoin, its users, or third parties. No compensation or refund will be provided for any actions taken under this section.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Pointcoin and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Pointcoin.

6. User Content

Our Service allows you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness.

By posting Content to the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service.

7. Termination and Account Actions

Pointcoin may, in its sole and absolute discretion, immediately and without prior notice or liability:

• Terminate or suspend your account and access to the Service
• Cancel pending reward redemptions and forfeit all earned rewards
• Delete all account data and associated information
• Block future access from your device or IP address
• Take any other action deemed necessary or appropriate

Such actions may be taken for any reason, including but not limited to: breach of these Terms, suspected fraudulent activity, violation of applicable laws, or to protect Pointcoin's business interests. You acknowledge that Pointcoin has no obligation to provide advance notice, explanation, or opportunity to cure any alleged violations.

Upon termination, your right to use the Service ceases immediately, and all earned rewards, points, and benefits are forfeited without compensation. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. Limitation of Liability

In no event shall Pointcoin, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

9. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

It is your responsibility to periodically review these Terms of Use for any changes. If at any point you do not agree with any modifications or updates to these Terms, you must immediately cease using the Service and contact us at help@pointcoin.co to request deletion of your account. Your continued use of the Service following any changes constitutes acceptance of those changes.
